Buying Property in Dubai as a Non-Resident

Anyone can buy in Dubai's freehold areas, whatever their nationality and whether or not they live in the UAE. The title deed is issued by the Dubai Land Department in the buyer's own name, and the purchase can be completed from abroad through a power of attorney.

Every community Heritage works in is freehold. What follows is the process as it runs in practice, and the points where a non-resident buyer is most often caught out.

Where you can buy

Dubai designates freehold areas in which foreign nationals own land and homes outright. They include Palm Jumeirah, Downtown, Dubai Marina, Emirates Hills, Dubai Hills, Jumeirah Bay, Mohammed Bin Rashid City, Dubai Creek Harbour, Bluewaters and the other master communities on this site. Older districts of the city are largely reserved for UAE and GCC nationals.

Ownership can be personal or through a company. Dubai-registered companies and companies in certain free zones can hold freehold property; an offshore company from elsewhere generally cannot without a local structure. We advise on the vehicle with the buyer's own lawyer.

The process

An offer is agreed and both sides sign the Land Department's sale contract, Form F, usually with a deposit of ten percent held by the agency. The developer issues a no-objection certificate confirming the service charges are paid. Buyer and seller, or their attorneys, meet at a registration trustee office, the price is paid by manager's cheque or bank transfer, and the trustee registers the transfer. The new title deed is issued the same day.

A cash purchase of a ready home takes two to four weeks from offer to deed. A financed purchase adds the bank's valuation and approval, typically another two to four weeks.

Buying from abroad

A buyer who cannot attend gives a power of attorney to a representative, signed before a notary and, if signed outside the UAE, attested by the UAE embassy and the Ministry of Foreign Affairs. Funds are transferred to the trustee office or to the seller against the deed. A UAE bank account is not required for a cash purchase.

Heritage arranges the notary appointments, holds the deposit under the agency's licence and represents the buyer at the transfer under the power of attorney.

Mortgages for non-residents

UAE banks lend to non-residents, usually at a lower loan-to-value than for residents and with checks on income and bank statements. The mortgage is registered against the title at the Land Department and the bank holds the deed until it is repaid. Inheritance and wills

UAE courts apply Sharia rules of succession by default. A non-Muslim owner who wants a different distribution registers a will with the DIFC Courts Wills Service or the Dubai Courts, which then governs the Dubai property. For a prime purchase this is part of the paperwork, not an afterthought, and we introduce a lawyer to draft it alongside the transfer.

Do I need a residence visa to buy in Dubai?+

No. Freehold ownership is open to any nationality, resident or not. A purchase of AED 2 million or more can in turn qualify you for a Golden Visa, but the visa is a consequence of ownership, not a condition of it.

Can I complete the purchase without travelling to Dubai?+

Yes, through a power of attorney signed before a notary and attested for use in the UAE. We represent buyers at the transfer under that authority.

Is the title deed in my own name?+

Yes. The Dubai Land Department issues the deed to the registered owner, personal or corporate, and it can be verified through the Department's Dubai REST app.

What happens to the property when I die?+

Without a registered will, UAE succession rules apply. A will registered with the DIFC Courts or the Dubai Courts governs your Dubai property under the terms you set.
